PNF Marketing - Terms and Conditions
Welcome to PNF Marketing. These Terms and Conditions outline the rules and regulations for the use of PNF Marketing's services. By engaging with our services, you agree to comply with and be bound by the following terms and conditions.
1. Services Offered
PNF Marketing offers a variety of marketing services, including but not limited to:
Digital marketing strategies
Social media management
Content creation
Videography production
Event media management
Website creation
Search Engine Optimization (SEO)
Influencer marketing
Email marketing
Brand consulting
2. Client Responsibilities
Clients are responsible for:
Providing accurate and up-to-date information necessary for the execution of the marketing services.
Timely feedback and approvals to ensure deadlines are met.
Ensuring all materials and content provided to PNF Marketing do not infringe on third-party intellectual property rights or violate any laws.
3. Social Media Management: Content Planner and Approval
For clients opting for social media management services that include a content planner:
For the initial three months of service, PNF Marketing will include up to 2 hours of edits of the content planner. After the initial 3-month period concludes, PNF Marketing will include up to 1-hour of edits in the social media management package.
After the included edit time, any additional time spent on further edits will be charged at £60 per hour.
Where applicable, all content must be approved by the client ahead of the scheduled start date of the content planner.
If content is not approved in advance, PNF Marketing will charge a surplus of £15 per post for each post that has to be manually created or adjusted outside of the planner schedule.
4. Fees and Payment Terms
All fees are agreed upon prior to the commencement of any project and outlined in the service agreement or invoice.
A deposit of 20% is required before any work begins, unless otherwise agreed upon in writing.
Final payment is due upon completion of the project or as specified in the invoice or agreement.
Payments are to be made via bank transfer.
Invoices are due upon receipt. Late payments of over 7 days may incur a 10% late fee.
5. Cancellations and Refunds
5.1 Social Media Management Cancellation
Social media management services may be cancelled by either party with one month written notice.
The client will remain responsible for all charges for services provided up until the cancellation date.
If the client cancels the service without providing the required one month’s notice, PNF Marketing reserves the right to charge for one additional month of service, based on the agreed upon monthly rate.
5.2 General Project Cancellations
Either party may cancel any non-social media project at any time with written notice.
In the event of cancellation, the client is responsible for payment of all work completed up to the date of cancellation.
Deposits are non-refundable unless otherwise specified in writing.
Any pre-paid fees for services not rendered may be refunded or credited toward future services, depending on the nature of the work.
6. Revisions and Alterations
For Social Media Management, see Section 3.
PNF Marketing will allow up to one rounds of revisions to the project without additional charge.
Any requests for additional revisions beyond the agreed number may incur additional fees, which will be communicated in advance.
7. Confidentiality
PNF Marketing agrees to keep all client information and materials confidential unless required by law to disclose such information.
Both parties agree not to disclose, share, or use any proprietary information, trade secrets, or confidential material without prior written consent.
8. Intellectual Property
All marketing materials, strategies, and content created by PNF Marketing are the intellectual property of the client once full payment has been made.
PNF Marketing retains the right to showcase non-confidential client work in its portfolio, website, or promotional materials unless the client objects in writing.
9. Liability
PNF Marketing shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the services, including but not limited to loss of profits, business, or data.
The maximum liability of PNF Marketing for any claim related to the services shall not exceed the fees paid by the client for the services giving rise to such claims.
10. Third-Party Services
PNF Marketing may recommend or use third-party services or platforms (e.g., Google Ads, Facebook Ads). PNF Marketing is not responsible for the performance or functionality of third-party services.
Clients are responsible for any fees, terms, and conditions associated with third-party services.
11. Force Majeure
PNF Marketing is not liable for failure to perform its obligations if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, or governmental actions.
12. Termination
PNF Marketing reserves the right to terminate any service agreement if the client breaches these terms or if the client engages in unethical or illegal activities.
Upon termination, the client will be invoiced for all completed work to date.
13. Governing Law
These Terms and Conditions are governed by the laws of the United Kingdom. The Parties agree to not initiate legal proceedings in relation to dispute unless they have tried and failed to resolve the dispute by negotiation.
14. Amendments
PNF Marketing reserves the right to modify or amend these Terms and Conditions at any time. Clients will be notified of any significant changes and continued use of services constitutes acceptance of the revised terms.
